This concept, which has replaced the archaic term "patria potestà " parental authority, emphasizes the best interests of the child, obliging parents to care for, educate, and protect their offspring, ensuring their psychophysical development.

In the daily lives of single parents, parental responsibility is typically exercised jointly, regardless of the type of /glossary/shared-custody or sole custody arrangements. Major decisions concerning children school choice, health, habitual residence must be made by mutual agreement between parents. Parents can act independently only for day-to-day matters. In cases of irreconcilable differences, judicial intervention is necessary.
Differences and Limitations
